These Terms of Service ("Terms") govern all purchases, online art instruction, and website usage through snowstorm.gallery (the "Site"), owned and operated by Snowstorm LLC, a Texas limited liability company operating under the names Catherine Snowstorm and Snowstorm Art Studio ("we," "us," "our"). Our companion Privacy Policy explains how we handle your personal information and is incorporated here by reference.

By purchasing artwork or enrolling in art classes, you ("Buyer," "Student," or "Parent/Guardian") agree to these binding Terms.

HOW THIS DOCUMENT IS ORGANIZED

This Terms of Service is divided into three parts:

• Part One — General Provisions: rules that apply across the entire Site, regardless of whether you're purchasing artwork or enrolled in a class — ownership of Site content, governing law, and how these Terms may change.

• Part Two — Art Studio: terms specific to enrolling in and attending Catherine's live online art classes — enrollment, the Military Family Scholarship, technical requirements, cameras and recording, catch-up videos, cancellations, and conduct.

• Part Three — Catherine Snowstorm: terms specific to purchasing original paintings, prints, postcards, and books through the Art Gallery & Shop — products, pricing, shipping, returns, and authenticity.

Sections are numbered within each part (e.g., II.1, II.2) for easy reference.

PART I: GENERAL PROVISIONS

I.1 OWNERSHIP & COPYRIGHT (SITE CONTENT)

All content on this Site — including its layout, design, logos, photographs, and text — not otherwise addressed as artwork (Part III) or class materials (Part II), is the property of Snowstorm LLC / Catherine Snowstorm and may not be copied, reproduced, or reused without prior written permission.

I.2 GOVERNING LAW & DISPUTES

These Terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-laws principles. Any disputes shall first be addressed informally by contacting catherine.snowstorm@gmail.com before pursuing legal remedies; if that fails, disputes will be subject to the jurisdiction of the courts of Texas, except where mandatory local consumer-protection law provides otherwise for buyers outside the US.

I.3 CHANGES TO THESE TERMS

We may update these Terms from time to time; the version in effect at the time you place an order or enroll in a class applies to that transaction. Continued use of the Site after changes means you accept the updated Terms.

PART II: ART STUDIO

II.1 ENROLLMENT & PARENTAL GUARDIANSHIP

Enrollment is open to students 13 years and older.

The enrollment process begins with an initial inquiry ("Step into the Studio!"), followed by formal registration forms — "Let’s get to know each other!" for adult students, or "Introducing Your Young Artist!" for minors.

• Minors (Under 18): Must be enrolled by a parent or legal guardian, who acts as the primary account holder and agrees to these Terms on the student's behalf.

II.2 MILITARY FAMILY SCHOLARSHIP

Each Art Studio group reserves two tuition-free spots for active-duty service members, veterans, National Guard/Reserve members, and their immediate family members (a spouse, parent, or child of one of the above), as well as Gold Star Family members (the immediate family of a service member who died while serving) (the "Military Family Scholarship"). Indicating eligibility on the enrollment form is entirely optional.

Verification: Before a tuition-free spot is confirmed, we ask you to complete our Military Family Scholarship verification form and upload proof of eligibility — for example, a photo of a military or dependent ID card, a DD-214 for veterans, or documentation of Gold Star Family status — with sensitive identifying numbers (such as a Social Security number or DoD ID number) covered or blacked out beforehand. If it's easier, this can also be done in person or by video call instead. See our Privacy Policy, Part II, for how we handle this verification and what we retain.

Group Placement: Each group reserves two Military Family Scholarship spots. If a third eligible applicant applies to a group that's already full, we'll offer a spot in a different group or time slot with an opening instead. If enough Military Family Scholarship students enroll, we may form a dedicated group sized to demand. Aside from tuition, Military Family Scholarship students receive the same instruction, materials, camera/microphone requirements (II.4), and Certificate of Completion (II.8) as every other student.

Expectations: A Military Family Scholarship spot is not just a tuition waiver — we ask scholarship students to hold themselves to the same standard reflected on the Certificate of Completion (II.8): attend every scheduled class, complete every Art Lab assignment, and, if a class is missed, catch up on that topic via the recording (II.5) and its Art Lab before the next class. As with any student, a topic that's missed and never caught up on simply won't appear on the final certificate.

II.3 CLASS FORMAT & TECHNICAL REQUIREMENTS

Classes are live, small-group online sessions (maximum 15 students) led personally by Catherine Snowstorm. Students must have a stable internet connection and a laptop or tablet monitor (phone screens are insufficient for visual detail).

Each class meets as a 2-hour core session — opening with a brief introduction and visual presentation, then moving into guided practical work. Two optional 30-minute segments are also offered around it: a Pre-Painter's Lounge beforehand, and a Post-Painter's Lounge afterward. Attendance at either Painter's Lounge is entirely optional and is not part of the core lesson — it's open time for questions about materials or a prior assignment, help catching up on a missed step, or feedback on finished work.

Because these are group sessions rather than private tutoring, a student's work, questions, and any feedback given during a Painter's Lounge may be seen or heard by other enrolled students in that group.

At the end of each core session, students receive an at-home assignment — Art Lab — to build on what was covered. Classes are conducted in English, and all instructional materials are provided in English only.

II.4 LIVE SESSION CAMERAS, MICROPHONE & RECORDING

Camera and microphone expectations differ by part of the class. During the core session's introduction and presentation (roughly its first 15 minutes), no camera or microphone is required — Catherine will be presenting or sharing her screen, and students may ask brief clarifying questions afterward.

During the core session's practical work portion, students are asked to keep two video feeds on by default: a work-surface camera (showing your drawing or painting surface, so Catherine can see your work in progress) and a face camera, along with your microphone. If you (or your child) prefer not to appear on the face camera, you may opt out and participate with that camera off, submitting questions in writing through the session chat instead. The work-surface camera remains necessary for instruction during this portion.

During an optional Pre- or Post-Painter's Lounge, a face camera is never required. A work-surface camera and microphone may be used if a student wants to show their work or ask a question, entirely at the student's option.

Only the core session is recorded. Recordings are retained for 30 days from the date of the session, after which they are deleted, and are used solely to give enrolled students who missed the core session the ability to catch up on the material covered (see II.5) — they are not published, shared publicly, or used for any other purpose without separate written consent. The optional Pre- and Post-Painter's Lounge segments are not recorded; a student who cannot attend one live is welcome to join a future Painter's Lounge instead.

Only Catherine's own recording of the core session, made through the class platform, is permitted. Students and parents/guardians may not independently record, screen-record, or otherwise capture any part of a live session — core session or Painter's Lounge — by any means, and may not distribute any such recording to anyone.

By enrolling in a live class, adult students, and parents/guardians on behalf of enrolled minors, consent to this camera, microphone, and recording practice, including the group visibility described in II.3.

II.5 CATCH-UP VIDEOS: ACCESS, VIEWING AGREEMENT & NO RECORDING

Enrolled students (or, for minors, their parent/guardian) who miss a core session may access that session's recording for 30 days after it was recorded, solely to catch up on material they missed. This applies to the core session only — the optional Pre- and Post-Painter's Lounge segments are not recorded (see II.4).

Catch-up videos are available to stream within the Site only — they cannot be downloaded, copied, or saved in any form.

Before viewing a catch-up video, you must agree not to share, forward, publish, or otherwise distribute the recording, or any portion of it, to anyone outside your own household. This agreement applies equally to adult students and to parents/guardians viewing on behalf of a minor student.

Re-recording, screen-recording, or otherwise capturing a catch-up video by any means is prohibited.

This restriction protects the privacy of the other students who appear and speak in the recording, as well as Catherine's original teaching materials.

II.6 SESSION PRESENTATIONS

After each live session, Catherine shares that session's presentation materials with all enrolled students, adult and minor alike (via the parent/guardian for minors), so they have a personal reference to review.

These presentations are provided for the personal, non-commercial use of the enrolled student (or their family) only. As with catch-up videos and other class materials (see I.1 and II.10), presentations may not be redistributed, published, or shared outside your own household without Catherine's prior written permission.

II.7 CANCELLATION & REFUND POLICY

• 7+ Days Prior to First Session: Full cash refund available upon written cancellation.

• Less than 7 Days Prior: Studio credit toward future course cycles may be granted at our discretion.

• After Course Start Date: No cash refunds are issued. Enrolled students retain 30-day access to that session's recording to catch up on missed lessons, under the terms of II.5 above.

II.8 CERTIFICATE OF COMPLETION

Each Art Studio course is broken into topics, including its culminating Final Master Project. At the end of a course, every enrolled student receives a uniquely numbered Certificate of Completion listing each topic they actually completed — whether by attending the live session, or by catching up on a missed session's recording (II.5) and finishing that topic's Art Lab. A topic a student missed and never caught up on is simply left off the certificate — there is no separate attendance-percentage or session-count requirement to receive one. The certificate itself is an accurate record of what was completed, however much or little that turns out to be, and this applies the same way across courses of any length.

Certificate of Completion numbers are recorded in a permanent internal registry. This registry is not public — looking up a certificate requires both the certificate number and the student's surname. Students may use their certificate number on job applications, portfolios, or elsewhere as proof of completion. If a student asks us to, we will remove their name and certificate number from this registry, and we'll notify affected students of any change to this system or how it can be accessed.

II.9 CONDUCT & LIABILITY

• Conduct: Respectful behavior toward the instructor and peers is required. The Studio reserves the right to remove disruptive participants without refund.

• Material Safety: Art instruction involves traditional drawing tools (charcoal, graphite, utility blades for pencil sharpening). Parents/guardians must supervise minor students during sessions and tool handling. To the fullest extent permitted by law, Snowstorm LLC is not liable for injuries resulting from improper tool usage or personal equipment setup outside class.

II.10 EDUCATIONAL MATERIALS & INTELLECTUAL PROPERTY

Class materials — including session presentations (II.6), session recordings, instructional guides, anatomical diagrams, and slides created by Catherine Snowstorm — are the exclusive intellectual property of Catherine Snowstorm / Snowstorm LLC and are provided solely for the personal development of enrolled students. Redistribution, publication, or recording of live sessions, catch-up videos, or class materials, beyond what's described in II.4–II.6 above, is strictly prohibited.

PART III: CATHERINE SNOWSTORM

III.1 PRODUCTS OFFERED

Through the Art Gallery & Shop, we offer several kinds of items ("Products"), each with its own nature:

• Original Paintings — unique, one-of-a-kind, hand-painted works, oil on canvas. See III.7 for what each listing describes.

• Limited Edition Fine Art Giclée Print — high-quality prints made with archival inks on museum-quality paper or canvas, numbered and signed. Listings say clearly when an item is a print rather than an original.

• Hand-Embellished Limited Edition Giclée on Canvas — the same as a Limited Edition Fine Art Giclée Print above, with each print individually hand-painted by Catherine with oil or acrylic highlights, making every piece unique in its texture and detail.

• Fine Art Postcard — small printed items featuring photographs of paintings.

• Books — where offered, printed or illustrated books featuring original illustrations created specifically for that book. Book illustrations are independent creative works and are not reproductions of any painting.

A note on "sold" originals

Most original paintings are truly one-of-a-kind: once sold, that specific piece is gone. However, for some paintings we note directly on the listing that we're willing to paint another version in the same size and materials on request. If so:

• Because each piece is hand-painted, a repainted version will have natural, minor variations from the original — it is not a mechanical copy.

• Size and certain details can be adjusted at your request.

• A repainted version is a commissioned work — see III.3 below.

If a listing doesn't mention this option, assume that painting is not available as a repaint.

III.2 PRICES AND PAYMENT

All prices are listed in US dollars (USD) unless otherwise noted, and do not include shipping, taxes, duties, or import fees unless stated. We reserve the right to correct listing errors (including obvious pricing mistakes) before confirming an order, and will contact you before charging a corrected price.

III.3 PURCHASING & COMMISSIONED REPAINTS

Original Paintings (Express Interest): Original paintings are ordered by submitting an inquiry through the "Express Interest" tab ("Send My Interest to Catherine"). We confirm the painting is still available and its price, then send a secure invoice through QuickBooks or Square. The order is confirmed once the invoice is paid in full. Because a painting’s listing is taken down or marked unavailable as soon as it sells, the information on the Site is always current — we do not invoice a painting that has already sold. If more than one person requests the same painting before it’s marked sold, it goes to whoever completes their request first — there is no bidding. We may decline or cancel a request for reasons such as suspected fraud or a shipping address we cannot ship to; if we do, no invoice will be issued, or any payment already made will be refunded in full.

Direct Checkout: Limited Edition Fine Art Giclée Prints, Hand-Embellished Limited Edition Giclée on Canvas pieces, Fine Art Postcards, and books (where offered) are purchased instantly through the Site's shopping cart and checkout. Payment is collected automatically through our payment partners; we do not see or store your full card number.

Commissioned Work (Including Repaints): If you'd still like a version of a painting that's just sold, we're often able to offer a commissioned repaint in the same size and materials, typically within 3–4 weeks. Commissioned paintings — including a requested repaint — are not covered by the ready-made purchase process above. Each commission is governed by its own written Commission Agreement, provided to you before work begins, which sets out pricing, deposit, timeline, revisions, and final-sale terms. Nothing in these Terms should be read as a commitment to accept any particular commission request.

III.4 SHIPPING, RISK OF LOSS, INSURANCE & CUSTOMS

We ship worldwide. Processing time before an item ships will be noted on the product listing or communicated after purchase.

We package each painting according to how it ships: stretched paintings travel in protective, heavy-duty boxes with multiple layers of bubble wrap; rolled paintings ship in heavy-duty tubes to prevent creasing. Shipping cost, including insurance, is calculated individually for each painting based on your delivery address.

Because original paintings in particular are fragile and irreplaceable, we keep responsibility for a Product while it's in transit: risk of loss and title pass to you only once the Product is delivered to your shipping address — not when it's handed to the carrier. If a shipment is lost or arrives damaged, contact us within 7 days of delivery (or, for a lost shipment, within 7 days of the expected delivery date) at catherine.snowstorm@gmail.com, with photos where applicable, and we'll issue a full refund or arrange a repainted replacement under III.3.

Local pickup or hand-delivery within the Austin, Texas area is available on request; if you choose this option instead of shipping, risk of loss and title pass to you at pickup or hand-delivery.

International buyers are responsible for any customs duties, import taxes, or brokerage fees charged by their country — these are not included in the purchase price or shipping cost, and we cannot predict their amount.

III.5 RETURNS & REFUNDS

14-Day Return Policy: You may return an original painting, Limited Edition Fine Art Giclée Print, Hand-Embellished Limited Edition Giclée on Canvas piece, or book for a full refund within 14 days of delivery, provided it's returned in the same condition it was sent, in its original (or equivalent protective) packaging. To start a return, email catherine.snowstorm@gmail.com with your order number. Unless the return is because the item arrived damaged or lost (III.4) or was materially different from its listing description, the buyer is responsible for return shipping costs and any related insurance. Refunds are issued to the original payment method once we receive and inspect the returned item, and typically take up to 10 business days to appear.

Custom Commissions: Commissioned works, including repaints, follow the return/refund terms of their individual Commission Agreement instead of this section.

Fine Art Postcards are final sale. If a postcard arrives damaged, misprinted, or isn't what you ordered, email us a photo within 7 days of delivery and we'll replace it or refund you — no return needed.

This policy is offered in addition to, and does not limit, any non-waivable consumer-protection rights you may have under the law of your country or state.

III.6 AUTHENTICITY & CERTIFICATE SUITE

Every original painting is created solely by Catherine Snowstorm. Depending on the item, it is accompanied by some or all of the following, in this order, each referencing our internal records and the painting's Certificate Serial Number:

1. Certificate of Authenticity — a signed, uniquely numbered certificate confirming the work is an original.

2. Bill of Sale (or, for gifted paintings, a Certificate of Gift) — documenting the transfer of ownership.

3. Artist Statement — the story and technique behind the piece.

4. Care Instructions — how to hang, handle, and preserve the artwork.

Certificate Serial Numbers are recorded in a permanent, public registry: entering a Certificate Serial Number allows anyone to look up which painting it corresponds to and view that artwork's details — not any information about the buyer. Because this registry documents the artwork rather than personal information about a person, entries cannot be removed on request. We'll notify affected parties of any change to this system or how it can be accessed. (This differs from the Certificate of Completion registry described in Part II § II.8, which is private and can be deleted on a student's request.)

III.7 PRODUCT DESCRIPTIONS & COLOR ACCURACY

For original paintings, Limited Edition Fine Art Giclée Prints, and Hand-Embellished Limited Edition Giclée on Canvas pieces, each listing describes the painting's name, medium or print support, year of creation (and, for prints, the year the print itself was made), dimensions, weight, framing (or, if unframed, edge treatment), whether it's ready to hang, where it's signed, its story and origin, and Certificate Serial Number where applicable. Listings for the two print types also note the edition size (or whether it's a Limited or Open Edition) and that individual print's number within the edition.

We do our best to describe and photograph each Product accurately, but colors can appear differently depending on your screen calibration and lighting conditions. Minor variation between a photo and the physical piece is normal for original, hand-painted work and is not considered a defect.

III.8 INTELLECTUAL PROPERTY

Selling you a physical item does not transfer copyright in the artwork it depicts. Catherine Snowstorm / Snowstorm LLC retains all copyright and reproduction rights in every painting and illustration sold or reproduced through the Site — including originals, Limited Edition Fine Art Giclée Prints, Hand-Embellished Limited Edition Giclée on Canvas pieces, Fine Art Postcards, and book illustrations — unless we agree otherwise in writing. You may display, photograph for personal use, and resell the physical item you purchased, but you may not reproduce, print, scan, or commercially exploit the underlying image or illustration without our written permission.

III.9 LIMITATION OF LIABILITY

To the fullest extent permitted by law, our liability for any claim arising from a purchase is limited to the amount you paid for the Product in question. We are not liable for indirect, incidental, or consequential damages.
